Terms of Service

Last updated 10 October 2026

Agreement

These terms are between you and Beat Fly Fishing LLC, a Washington limited liability company (“Beat”, “we”). By using the Beat app or this site you accept them. If you do not, please do not use Beat.

How we handle your information is covered separately in our Privacy policy, which forms part of these terms.

Your account

You need an account to use Beat, you must be at least 13, and you are responsible for what happens under your account. Sign-in runs through Apple or Google, so keeping that account secure is what keeps your atlas secure. Tell us promptly if you believe someone else has access.

Your content stays yours

You own what you put into Beat: your notes, your logged catches, your photos, the beats you write. We claim no ownership of any of it.

To run the service we need a narrow licence: permission to store, back up and display your content to you, and, only for content you choose to publish, to display and deliver it to the people you publish it to. That licence exists so the product can function, it is limited to that purpose, and it ends when you delete the content, save for copies a buyer has already lawfully received and ordinary backups aging out.

Selling beats

If you sell through the marketplace you are selling your own work as an independent seller, not as our employee or agent. You are confirming that it is yours to sell and that selling it breaks no law and no agreement you are under.

  • Our fee is 20% of the sale price. The remainder is transferred to your connected Stripe account, less Stripe’s own processing fees.
  • Payouts run through Stripe. You will need to complete Stripe’s onboarding and accept the Stripe Connected Account Agreement; until Stripe clears your account it cannot pay you, and that part is outside our control.
  • Tax is yours. You are responsible for your own income tax. Where the law requires it we will report your earnings and issue the applicable tax forms.
  • You set the price. We may remove a listing that breaches these terms, and we will tell you why.

Refunds

A beat is written knowledge, delivered immediately and impossible to hand back, so the ordinary rule for digital goods applies: sales are final once delivered. We would rather be straight about that than imply a return window that does not exist.

But we will refund you in full if:

  • the beat never delivered, or will not open;
  • you were charged more than once for the same beat;
  • the beat is materially not what it described: wrong river, empty, or plagiarised from someone else.

Write to hello@beatflyfishing.com within 14 days of the purchase with your receipt. We aim to answer within two business days, and an approved refund returns to your original payment method, normally within five to ten business days once issued.

What is notgrounds for a refund: the fish were not biting. A beat is one angler’s hard-won knowledge of their water, not a guarantee of a day’s fishing, and nobody can promise you that.

If you bought through Apple’s in-app purchase, Apple handles that refund under its own terms. We cannot issue it for you, though tell us anyway if something was wrong and we will put it right with the seller.

Where a refund is issued on a sale, the corresponding amount is reversed from the seller’s proceeds.

The guide directory

Beat lists fly fishing guides and shops as a public directory, and it is exactly that: a listing. We are not affiliated with these businesses, we take no cut of their work, we hold no booking and we do not vouch for them. Hiring a guide is an arrangement between you and them.

If a listing is yours you can claim it to correct it. Claiming requires verifying you control the business’s published contact details, and we may refuse or reverse a claim we think is wrong.

Fair use of Beat

Do not:

  • publish content you do not have the right to publish, or pass off someone else’s water knowledge as your own;
  • scrape, bulk-download or resell the atlas, the guide directory or other anglers’ beats;
  • attempt to reach another angler’s private atlas, or probe our systems for a way in;
  • post anything unlawful, abusive or deliberately misleading, including a listing or beat for water you have never fished;
  • use Beat to help anyone break fishing law.

On that last point, and we mean it as more than boilerplate: you are responsible for fishing legally and responsibly on the water you fish. Licences, seasons, closures, gear restrictions and spawning protections are set by your local authority, they change, and nothing in Beat overrides them. Information in the app is one angler’s account, not a regulation, and never permission.

Beat is a journal, not a safety device

Rivers are dangerous. Water levels, weather, wading conditions and access all change faster than any app, and Beat is a record of past trips rather than a live report. Do not rely on it for your safety, your navigation, or whether a crossing is passable today. Check conditions yourself, and turn back when you should.

Service and changes

We will try to keep Beat available and working, but it is provided as is, without warranty of any kind, and we do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue something you have paid for, we will give you reasonable notice and a fair way out.

Limitation of liability

To the fullest extent the law allows, Beat is not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost data or lost fishing. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow these limits. Where that is so, they apply only as far as permitted, and nothing here excludes liability that cannot lawfully be excluded.

Indemnity

If a claim is brought against us because of content you published or something you did on Beat in breach of these terms, you agree to cover the resulting costs.

Ending it

You can stop using Beat and delete your account whenever you like. We may suspend or close an account that breaches these terms, and except in a serious case we will tell you why first. Content you bought stays available to you while your account is open.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules, and the state and federal courts of King County, Washington have exclusive jurisdiction. If any provision is unenforceable the rest stands.

Changes to these terms

We will update the date at the top when these change, and tell you in the app when a change is material. Continuing to use Beat after a change means you accept it.
